Brexit Implications on Stella Connect Data


All data transfers to and from Stella Connect are based on the standard contractual clauses, which will remain a legal justification for data transfer in the case of a hard Brexit. This means that no changes need to be made in the current setup for Stella Connect companies that are transferring data in and out of the UK.

Brexit has implications for United Kingdom companies who are transferring data from outside the UK into the country, and for EEA companies transferring data to and from the UK. It also has implications for any company outside the UK transferring data in or out of the UK.

However, the general protections of GDPR are expected to remain in place for UK companies. The legal justification for transfers to and from the UK will no longer be supportable as an intra-EEA transfer. Instead, such transfers will need to be supported by the standard contractual clauses.

The standard contractual clauses themselves are currently up for debate in the CJEU, but the timeline for that is unrelated to Brexit and will have far greater implications than Brexit for international data transfer.
